General Regulation to the Organic Law of Youth

On March 20, 2024, the President of the Republic issued the Regulation to the Organic Law of Youth.

KEY ASPECTS IN LABOR MATTERS

  • Employers with 50 or more workers are required to hire at least 10% of young people, aged 18 to 29, high school graduates or graduates, without professional experience, meaning they should not have employer contributions in the Ecuadorian Social Security Institute in the labor relationship (internships or traineeships are not excluded).
  • The inclusion percentage will be calculated based on the total workforce, except for those whose contracts are not of a stable or permanent nature (casual, occasional, special emergent, productive, and determined work).
  • The mandatory hiring percentage will be implemented progressively, in accordance with the regulations issued by the Ministry of Labor within 180 days from the date of publication of the Regulation to the Law.
  • The Ministry of Labor will monitor, control, and follow up on compliance with the percentage, and will apply sanctions.
  • Private companies will develop comprehensive prevention programs for the use and consumption of drugs, to be implemented in the workplace by qualified personnel.

This Regulation will enter into force once it is published in the Official Registry.
