Implementation of the Supervision and Control Fee by the Mining Regulation and Control Agency (ARCOM)

In Official Gazette No. 64 dated June 20, 2025, Resolution No. ARCOM-003/25, issued by the Mining Regulation and Control Agency (hereinafter, “ARCOM”), was published. Through this resolution, ARCOM established the Supervision and Control Fee. The implementation of this fee aims to strengthen technical supervision and control activities, enhance operational and logistical management, and support the acquisition and implementation of technological tools that will enable broader oversight activities throughout the national territory.

Who must pay this fee?

  1. The fee must be paid by holders of mining rights, mining exploitation contracts, licenses, permits, or authorizations for the installation and operation, smelting, or refining plants, as well as those holding commercialization licenses.

Frequency and Deadline for Payment:

2. For medium-scale mining, large-scale mining, and commercialization licenses, the fee must be paid semiannually. Those operating under the small-scale mining regime must fulfill this obligation annually.

3. The payment periods are as follows:(i) First period ending june 30, with payment due by July 31 of the same year; and (ii) Second period ending December 31, with payment due by January 31 of the following year. Payment shall be made through the mechanisms enabled by ARCOM for this purpose.

Failure to pay will result in the initiation of coercive collection proceedings.

Determination of the fee:

4. The applicable fee will be determined based on the percentage outlined in Annex 1 of the Resolution, calculated as a percentage of the Unified Basic Salary per mining hectare, according to the following:

    a) Small-scale mining:

      • Initial exploration: 10% UBS
      • Exploration: 15% UBS
      • Exploration–exploitation: 20% UBS
      • Exploitation: 25% UBS

      b) Medium-scale mining:

      • Initial exploration: 30% UBS
      • Advanced exploration: 40% UBS
      • Economic assessment: 20% UBS
      • Exploitation: 50% UBS

      c) Large-scale mining:

      • Economic assessment: 25% UBS
      • Exploration: 50% UBS
      • Initial exploration: 25% UBS
      • Advanced exploration: 75% UBS
      • Exploitation: 100% UBS

      d) General Regime:

      • Initial exploration: 25% UBS
      • Advanced exploration: 75% UBS
      • Exploration–exploitation: 25% UBS
      • Exploitation: 100% UBS

      e) Non-metallic mining:

      • Small-scale mining: 3% UBS
      • Medium-scale mining: 5% UBS
      • Large-scale mining: 7% UBS
      • General Regime: 7% UBS

      f) For commercialization licenses, the fee is set at 10 UBS, regardless of the mining surface area. In this case, the amount payable will be the result of multiplying the applicable coefficient for the commercialization phase by the number of Unified Basic Salaries, without reference to hectares.
