On January 10, 2023, the Organic Law to Promote the Violet Economy was enacted and published in Supplement to Official Register No. 234 on January 20, 2023. Article 18 of this Law establishes:
“(…) Companies’ Equality Plans are a set of measures adopted after conducting a situational diagnosis, created with the aim of achieving fair and equal treatment and opportunities between women and men within the company, eliminating any type of gender-based and multicultural discrimination. Equality Plans will include the strategies and practices to be adopted to achieve these goals, as well as the establishment of effective systems for monitoring and evaluating the objectives set. Equality Plans will cover all company facilities, without prejudice to the establishment of special appropriate actions regarding certain workplaces.”
Subsequently, Ministerial Agreement No. MDT-2024-013, dated January 19, 2024, and published in Supplement to Official Register No. 492 on February 5, 2024, was issued by the Ministry of Labor to establish the Guidelines for the Registration of Equality Plans.
On July 30, 2025, through Ministerial Agreement No. MDT-2025-083, signed by the Minister of Labor, Ivonne Elizabeth Núñez Figueroa, the second paragraph of the First Transitional Provision of Ministerial Agreement No. MDT-2024-013 was amended as follows:
“The deadline for private-sector employers with 50 or more employees to register their ‘Equality Plans’ with the Ministry of Labor through the Unified Labor System (SUT) is extended until December 31, 2025.”
The Ministry of Labor also indicated that, once the established deadline has passed, it will initiate control and sanction procedures in the event of non-compliance after this date.
